wrecked my car and need some help

Post by Toval »

so last wednesday it was raining pretty good on the way to work. I was driving along in the lefty lane when the car started to hydroplane. long story short, I slammed ass first into a concrete barricade on the side of the highway and then rolled across the highway and came to a stop on the other shoulder.

single car accident, I was alone in the car and not injured.

I had the car towed to a repair shop that the insurance company recommended and got set up with a rental.

Today I heard from them with an appraisal on the repairs. they said it would cost approx $9,700 to fix the car, and that it was still a couple of thousand away from being a total loss.

Now I hate, hate, H.A.T.E. this car. Ive been wanting to get out of it for a long time.

I have approx $7,500 left on the car note (3 years of payments left)

since the repair estimate is more than the cost of the car, Im wondering if I can just tell the insurance company to give me a check for the $9700, then use that to pay off the note and sell the car to a junk yard or something. then use the remainder to put a down payment on a new car.

anybody here have any experience with anything like this?

Afraid I can't help you out with this, Dutch law is very different to USA law and I haven't exactly been in a situation like this before.

Talk to your Insurance agent/company. Only an Insurance appraiser can declare if the vehicle is a total loss or not. Also, look up the Kelley Blue Book value of your car with the current mileage and condition of your car. This information will potentially help you make a case with your insurance company for getting the car declared 'totaled'.

I had a similar incident a few year back on snowy roads here in the NotrhEast US. I was able to keep the car from rolling but ran into an embankment and totaled my Cadillac Catera. I wouldn't count on the insurance company giving you a check. It is cheaper for them to fix the car than total it otherwise they would have just totaled the car. I think you are SOL in terms of getting a check to get a new ride.

I got a check from the Insurance company today for the ammount they quoted the repair cost at.

going with my dad (cosigner) tomorrow to close out the note and that pile of junk will be mine.

using the balance of the repair check to put a downpayment on a new car. then selling the junker to a scrap yard or something.

It is a good thing your insurance let you keep the car itself.

A lot of times they take it and sell it for junk yards themselves. It should get you a few more hundred if the engine and transmission is still good.

my payments are less than with the old car, and I dont hate the new one :) all I had to put down was TT&L
